- It is not confirmed that original author was employee of the U.S. Navy and image was taken or made as part of that person's official duties (author not listed in source, no copyright information on website) Bulwersator (talk) 17:40, 8 September 2012 (UTC)[reply]

- Well, that's not completely certain, without more info — she might have died soon after the picture was taken, and then the photographer lived another 20 years; that's not implausible at all. But surely it qualifies as a work published in the US before 1923? Even if that makes it PD only in the US, that's still good enough to save it from deletion. I suppose there's a slim chance it could have lingered in an attic somewhere and then been published only after 1923; can we rule that out somehow? --Trovatore (talk) 22:13, 9 September 2012 (UTC)[reply]
- Do you have any evidence that it is a published photo? If unpublished, it is copyrighted for 70 years since the death of the photographer, or (if the photographer is unknown) for 120 years since the photo was taken. If taken in 1892, unpublished and anonymous, it remains copyrighted for slightly less than four months. If taken in 1892, unpublished but not anonymous, it might be copyrighted for a longer time. Probably PD, but if you are in doubt, let's keep it as fair use until the end of the year and then change back to PD again. --Stefan2 (talk) 17:32, 11 September 2012 (UTC)[reply]

- First version is from Flickr and is "non commercially" and second version is said to come from the State of Maryland or the University of Maryland. The license says it is "public domain in the United States because it is a State of Maryland State Archive". Is that correct? If so we need a better link/source.
